These Terms and Conditions ("Terms") govern your use of the website at www.benalmadenapestcontrol.com and the pest control services provided by Biopest Control De Plagas SLU (CIF B72454333), trading as Benalmádena Pest Control ("we", "us", "our").

By requesting a quote, booking a service, or using this website, you agree to these Terms. Please read them carefully.

2. Services

We provide professional pest control treatments for residential and commercial properties in Benalmádena and the surrounding Costa del Sol area. Services include, but are not limited to, treatments for cockroaches, ants, wasps, rodents, bedbugs, and mosquitoes.

All services are carried out by qualified, ROESB-certified technicians using approved biocidal products.

We reserve the right to decline or discontinue a service where, in our professional judgement, it cannot be safely or effectively performed (for example, where access is restricted, the infestation is beyond the scope agreed, or site conditions present a health and safety risk).

3. Quotes and Bookings

• All quotes provided by phone, WhatsApp, email, or via our website contact form are free and non-binding until confirmed in writing.
• A quote is valid for 30 days from the date of issue unless otherwise stated.
• A booking is confirmed when you receive written confirmation from us (email or WhatsApp message).
• Quoted prices are based on the information provided at the time. If the actual scope of work differs materially from what was described, we may revise the price before treatment begins.

4. Pricing and Payment

• Typical treatments range from €89 to €250 depending on pest type and property size. Commercial contracts are priced separately.
• All prices are inclusive of VAT (IVA) at the applicable rate unless otherwise stated.
• Payment is due on the day of treatment unless a commercial credit account has been agreed in advance.
• We accept cash, credit/debit card, and bank transfer.
• Invoices for commercial clients are payable within 14 days of the invoice date unless otherwise agreed in writing.
• Late payments may attract interest at the statutory rate under Spanish commercial law.

5. Cancellation and Rescheduling

• You may cancel or reschedule a booking free of charge by giving us at least 24 hours' notice before the scheduled appointment.
• Cancellations made with less than 24 hours' notice, or failure to provide access at the agreed time, may result in a call-out charge of up to €50 to cover the technician's time and travel.
• We will always endeavour to give you as much notice as possible if we need to reschedule due to circumstances outside our control (e.g. technician illness, severe weather).

6. Your Responsibilities

To allow us to carry out an effective treatment, you agree to:

• Provide accurate information about the pest problem, property type, and any relevant conditions (pets, allergies, young children, pregnancy) before treatment.
• Ensure reasonable access to all areas requiring treatment at the agreed appointment time.
• Follow any preparation instructions we provide before the visit (e.g. clearing under kitchen units for cockroach treatments).
• Follow all post-treatment instructions, including recommended re-entry times (typically 30–60 minutes after treatment, or as advised by the technician).
• Keep children and pets out of treated areas for the time specified by the technician.
• Inform us of any change in circumstances that may affect the treatment or its effectiveness.

7. Treatment Guarantee

We offer a 30-day re-treatment guarantee on standard residential treatments. If the treated pest reappears within 30 days of the original treatment, we will return and retreat your property free of charge, subject to the following conditions:

• You have followed all post-treatment instructions provided by our technician.
• The re-infestation is of the same pest species treated originally.
• The property has not been exposed to a new source of infestation (e.g. new furniture, returning guests) that could reasonably explain the reappearance.
• Payment for the original treatment has been received in full.

The guarantee does not apply to ongoing pest management contracts, commercial properties, or where infestation is caused by factors outside the treated area (e.g. shared drains or neighbouring properties).

8. Liability

We carry full public liability insurance. Our liability to you is limited as follows:

• We are not liable for any pre-existing damage to your property, or for pest damage that occurred before our treatment.
• We are not liable for indirect, consequential, or economic losses (including loss of business, revenue, or use of premises) arising from a pest infestation or our treatment of it.
• Our total liability to you in connection with any single service shall not exceed the amount paid for that service.
• Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, as required by applicable law.

You are responsible for ensuring that third parties present at your property during or after treatment are made aware of any re-entry instructions we provide.

9. Health, Safety, and Biocidal Products

• All products used are approved for use in Spain and applied in accordance with manufacturer instructions and ROESB regulations.
• You must disclose any known allergies, medical conditions, or the presence of aquariums, beehives, or other sensitive elements before treatment begins.
• We accept no liability for adverse reactions resulting from failure to disclose relevant information.

10. Intellectual Property

All content on this website — including text, images, logos, and layout — is the property of Biopest Control De Plagas SLU or its licensors. You may not reproduce, copy, or distribute any content without our prior written consent.

11. Website Use

This website is provided for information purposes and to allow you to request a quote. We make reasonable efforts to keep the content accurate and up to date but do not warrant that it is free from errors or omissions. We reserve the right to change, suspend, or withdraw the website at any time without notice.

12. Privacy

We take your privacy seriously. Please read our Privacy Policy to understand how we collect, use, and protect your personal data.

13. Governing Law

These Terms are governed by the laws of Spain. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain.

If you are a consumer, you also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to These Terms

We may update these Terms from time to time. The "last updated" date at the top of this page will reflect any changes. Continued use of our website or services after any changes constitutes acceptance of the revised Terms.
